This agreement is executed between a company and an employee to record the latter’s commitment to return a percentage of the training fees that the company had paid on behalf of the employee in case he/she resigns.
The percentage is generally deducted from the employee’s entitlements and should be proportionate to the period that the employee spent in the company.
This agreement is used by companies registered in the DIFC.
In addition to the employee’s termination of the employment contract, this agreement grants the company the right to deduct a percentage of the employee’s entitlements if it terminates the employment under article 63 of DIFC Employment Law No. 2 of 2019 (as amended).
Furthermore, the agreement releases the employee from the obligation to reimburse the company if he/she terminates the employment relationship pursuant to the same article.
